JUDGEMENT

(1.) (Oral) - Crl. Misc. No. 2787 of 2016 This application has been moved for amendment in the head note of the main petition as the name of the Act i.e Immoral Traffic (Prevention) Act, 1956 was not mentioned and for placing on record the amended head note as Annexure P-4. Criminal Misc. Application is allowed and the head note of the main petition is amended to the extent that the Act "Immoral Traffic (Prevention) Act, 1956" be now read in the head note. Crl. Misc. No. M-1337 of 2016

(2.) This is the second petition, which has been filed under Sec. 439 Cr.P.C for grant of regular bail to the petitioner in case FIR No.319 dated 05.10.2015 under Sections 3(1), 5(A), 5(B), 5(B)(2) and 5(C) of Immoral Traffic (Prevention) Act, 1956 registered at Police Station Butana, District Karnal.

Learned counsel for the petitioner submits that after declining the earlier petition filed by the petitioner, his co-accused has been granted bail vide order dated 14.01.2016 passed in Criminal Misc. No.M-44180 of 2015 by the co-ordinate Bench. Learned counsel further submits that the petitioner is in custody since 05.10.2015. Challan has also been presented. No useful purpose would be served by keeping the petitioner in custody.
