RAM PAL Vs. SANTOSH AND OTHERS

Decided On January 08, 2016
RAM PAL Appellant
V/S
Santosh And Others Respondents

JUDGEMENT

(1.) Present revision petition under Article 227 of the Constitution of India is challenge to the order dated 28.11.2013 [Annexure P/1], whereby application under Order XXI Rule 32 CPC filed by the petitioner was dismissed by Civil Judge [Junior Division], Pehowa.

(2.) Learned counsel for the petitioner submitted that learned trial Judge fell in error while declining the request as the petitioner had sought police help for implementation of the judgment and decree dated 19.09.2012 and correction order dated 26.10.2012 but the same was dismissed without considering the merits of the case. The order be setaside. Having considered the submission made by learned counsel for the petitioner, this Court is of the considered view that learned trial Judge has rightly dismissed the application under Order XXI Rule 32 CPC because the same does not relate to providing of police help for implementation of the judgment and decree. No case was made out for police help. Thus, there is no illegality in the order passed by learned trial Judge.

(3.) In view of the above, the present revision petition stands dismissed being devoid of any merit.
