PARAMJIT SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Prayer is for grant of regular bail under Section 439 Cr.P.C. to the petitioner -Paramjit Singh in case FIR No.34 dated 11.03.2016 for the offences punishable under Section 15 of the Narcotic Drugs and Psychotropic Substances Act (for short 'NDPS Act'), registered with Police Station Haibowal, Ludhiana.

(2.) There is a recovery of 03 Kgs. of Poppy Husk, which quantity concededly is non -commercial in nature, therefore, the bar provided under Section 37 of the NDPS Act is not applicable.

(3.) There is another FIR No.35 dated 22.02.2015, u/s 15 of the NDPS Act, Police Station Sarabha Nagar, District Ludhiana wherein 7 Kgs. of Poppy Husk was recovered, which quantity also is non -commercial in nature and the petitioner is on regular bail.
