BIR SINGH Vs. STATE OF HARYANA

JUDGEMENT

(1.) Petitioners, namely, Bir Singh, Rattan Singh, Deepak, Abhey Singh and Sultan Singh have filed the instant petition under section 482 Cr.PC for quashing of FIR No.217 dated 06.12.2015 for offences punishable under Sections 323, 506 and 34 of Indian Penal Code, later on added Section 307 Indian Penal Code registered with Police Station Ateli, District Mahendergarh (Annexure P -1) and all the subsequent proceedings arising therefrom on the basis of compromise dated 13.12.2015 (Annexure P -2).

(2.) Upon notice of motion parties were given liberty to approach the learned Illaqa Magistrate by making appropriate application for getting their statements recorded in terms of the compromise and who shall submit its report regarding the genuineness of the compromise.

(3.) Report (Mark -A) in the shape of letter dated 5.5.2016 of learned Judicial Magistrate Ist Class, Narnaul duly forwarded by learned District & Sessions Judge, Narnaul vide letter dated 5.5.2016 has been received wherein it is stated that the parties appeared before that court and suffered statements recorded separately in terms of the compromise thereby stated that the matter between the parties has been compromised and complainant has no objection if the aforesaid FIR and all consequential proceedings are quashed against the petitioners.
