JUDGEMENT

(1.) By this single judgment, I shall dispose of two connected appeals i.e. CRA No. S -1259 -SB of 2013, filed by accused/appellant Harpal Singh alias Raju and CRA No. S -2300 -SB of 2013, filed by accused/appellant Ompal, arising out of the same judgment of conviction dated 31.1.2013, vide which the accused/appellants were convicted under Ss. 21 (c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (in short 'NDPS Act') and order of sentence dated 4.2.2013, vide which they were sentenced to undergo rigorous imprisonment for 10 years each and fine of Rs. 1,00,000/ - each, in default thereof, to further undergo rigorous imprisonment for 3 years each under Sec. 21 (c) of the NDPS Act, passed by the learned Judge, Special Court, Chandigarh. They were also sentenced to undergo rigorous imprisonment for 10 years each and fine of Rs. 1,00,000/ - each, in default thereof, to further undergo rigorous imprisonment for 3 years each under Sec. 29 of the NDPS Act. Both the sentences were ordered to run concurrently.

(2.) The present appellants were tried on the complaint filed by Narcotics Control Bureau, Chandigarh, Zonal Unit (in short 'NCB'). The facts of the case are as under: - -

(3.) The accused were charge -sheeted under Ss. 8/21 and 29 of the NDPS Act. The accused pleaded not guilty to the charge and claimed trial.
