(1.) The petitioners seek grant of regular bail in case FIR No.153, dated 26.8.2016, registered under Sections 506/420 of the IPC, at Police Station Division No.5, District Police Commissionerate, Ludhiana.

As per allegations, the petitioners agreed to sell land measuring 680 sq. yards to the complainant and, over a period of time, took a sum of Rs. 2.02 crores out of total consideration of Rs. 2.31 crores. Thereafter, at their request, the date to execute the sale deed was also extended on two occasions but ultimately they refused to execute the same. Counsel for the petitioners has argued that this is a civil dispute.

Counsel for the complainant has, however, pointed out that in the agreement to sell, the petitioners had categorically mentioned that not only would they sell the land to the complainant but they would also ensure that the handling and maintenance contract of the pump which was presently with their nominee, would also be transferred to the complainant but 10 months after the agreement to sell that handling and maintenance business was transferred to some body else. Counsel for the complainant, as well as learned Addl. AG Punjab have stated that this was the fraudulent act of the petitioners.
