JUDGEMENT

(1.) The dispute herein pertains to custody of the minor child, namely, Anshul (Pranav). Operative part of the order, under challenge, reads thus:-

(2.) Both the parties are present in person. With the assistance of counsel for the parties, a compromise now has been effected, whereby the parties have agreed that custody of the child will be handed over by the husband to the wife once in a month, on every second Saturday, at the gate of Rose Garden, opening towards Sector 17, Chandigarh at 10 a.m. The wife will keep the child with her upto 5 p.m., from April to October and for rest of the months of the year, upto 4 p.m. and then she will hand over custody of the child, to the husband at the same gate of Rose Garden. It has further been agreed between the parties that during summer vacations, the wife shall take the child for a period of first five days of the vacations.

(3.) The appellant shall intimate the wife, in advance, as to from which date summer vacations will start. Intimation shall be sent through registered post and also through a telegram. The custody for the said purpose shall again be handed over at the gate of Rose Garden, as mentioned above and on the sixth day in the morning at about 12 noon, the respondent-wife shall hand over custody of the child to the husband in the same manner, in which, it was handed over to her. In view of agreed stand taken, with above-mentioned observations, appeal stands disposed of.
