JUDGEMENT

(1.) This writ petition has been filed with a prayer to issue a writ of mandamus, directing the respondents to sanction building plans, submitted by the petitioner.

(2.) In reply, it has been stated that as plot of the petitioner falls in area, earmarked for a public park, in the Town Planning Scheme, building plan cannot be sanctioned, as submitted by him. There is a serious dispute on facts. No finding in that regard, can be given by this Court, at this stage. However, this writ petition is disposed of by issuing a direction to the

Municipal Corporation- respondent No.3, to effect measurement at the spot, in the presence of the petitioner and if his plot does not fall in the area, earmarked for the park, necessary permission be granted to sanction the building plan. If situation is to the contrary, any other order be passed, as per law. Needful be done within six weeks from the date of receipt of a copy of this order.
