(1.) The petitioners have filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 60 dated 27.6.2006 registered under Sections 452/423/307/506/34 IPC at Police Station Mohana, Tehsil and District Sonepat. I have heard the counsel for the parties.
(2.) In this case, as per the prosecution version, injury No.4 on the person of Phool Kumar, has been declared dangerous to life for which the offence under Section 307 IPC has been added. The said injury has been attributed to petitioner No.2-Satbir Singh. Keeping in view the nature of injuries caused by him, I am not inclined to grant regular bail to petitioner No.2-Satbir Singh at this stage. Dismissed qua petitioner No.2-Satbir Singh.

As far as petitioner No.1-Satish is concerned, he was already granted regular bail on 3.7.2006 for the offences under Sections 452/423/506/34 IPC and subsequently he was arrested when the offence under Section 307 IPC was added. Counsel for the petitioners contends that as far as the injuries under Section 307 IPC are concerned, those have not been attributed to petitioner No.1-Satish. The petitioner No.1 is in custody since 28.8.2006. This fact has not been disputed by the State counsel. Keeping in view the aforesaid facts and the custody period, I deem it appropriate to grant regular bail to petitioner No.1-Satish and he is accordingly ordered to be released on bail to the satisfaction of the trial Court.
