JUDGEMENT

(1.) THE plaintiff is in second appeal arising out of a suit for possession claiming pre-emptory right in terms of Section 22 of the Hindu Succession Act, 1956.

(2.) THE learned Courts below have recorded a finding that Section 22 of the Hindu Succession Act, 1956 is not applicable to the agricultural land. In the said finding, reliance has been pleased on a judgment of Divison Bench of this Court, "1970 PLJ-587, Jaswant and others v. Basanti Devi".

(3.) DISMISSED . Appeal dismissed.
