JUDGEMENT

(1.) The petitioners filed CWP No. 5057 of 2001 in which vide order dated April 4, 2001, the respondents were directed not to promote any persons junior to the petitioners without considering their claims. The above said writ petition has thereafter been admitted and the interim order is still operative. Alleging that persons junior to the petitioners have been promoted without considering the petitioners' claim, this contempt petition has been filed.

(2.) In response to the show cause notice, an affidavit dated 1.8.2006 of Shri Sarvesh Kaushal, Secretary to Government of Punjab, Department of School Education has been filed which is taken on record. Along with the said affidavit, two orders, i.e., a speaking order dated 12.5.2006 (Annexure R-1) and dated 10.7.2006 (Annexure R-2) have been appended. Vide the first order, the dispute of the petitioners vis-a-vis their alleged juniors have been determined and vide subsequent order, certain promotions as Principals in Punjab Education Service (School and Inspection Cadre) Group A have been made.

In view of the fact that the petitioners' cases were duly considered by the competent authority while making aforesaid promotions, it cannot be said that the interim order dated April 4, 2001 has been violated. Consequently, this petition is disposed of with liberty to the petitioners to impugn the above said orders, Annexures R-1 and R-2, if so advised.
