JUDGEMENT

(1.) COUNSEL for the petitioners states that as per contents of the FIR, the complainant has suffered injuries on non-vital parts of his body, i.e., hand and finger, whereas as per version of the petitioners, opposite party was the aggressor and it had caused injuries to petitioner No. 1, which was found to be a fracture and declared grievous. It has been stated that it is a case of version and counter-version and it is yet to be ascertained as to which party was the aggressor. It has further been brought to the notice of the Court that concession of anticipatory bail was extended, in favour of the opposite party, by the trial Court. Facts referred to above, have not been controverted by the State counsel.

(2.) IN view of facts mentioned above, this petition is allowed and subject to petitioners' joining the investigation, as and when asked to do so by the INvestigating Officer, and furnishing bail/surety bonds to his satisfaction, their arrest shall remain stayed till further orders.
