JUDGEMENT

(1.) The challenge in the present revision petition is to the order passed by the learned Rent Controller on 22.02.2005 whereby the application filed by the petitioner for permission to file written statement was declined.

(2.) It has been contended that though there is some delay in filing of the written statement but the petitioner is ready to compensate the respondent for the delay in filing of written statement. Keeping in view the said fact, the petitioner is permitted to file written statement subject to payment of Rs. 2000.00 as costs. The written statement may be filed along with costs of Rs.2000.00 - on 27/3/2006. On the payment of such costs, the learned Rent Controller shall proceed to record the evidence on the date already fixed i.e. 31/5/2006.

(3.) The parties through the learned counsel are directed to appear before the learned Rent Controller on 27/3/2006 for payments of costs and for filing of written statement. The revision petition stands disposed of accordingly.
