JUDGEMENT

(1.) Heard. Offence alleged is under section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

(2.) The petitioner was earlier granted anticipatory bail during investigation. Now, he is in custody since 1.12.2005.

(3.) It is submitted that identity of the petitioner is debatable, as he was not arrested on the spot and recovery was from open space and he was not arrested soon after the occurrence.
