JUDGEMENT

(1.) The main grievance of the plaintiff-appellant in the present appeal is that although the plaintiff had been found to be in possession of the suit property but still, no injunction had been issued in his favour.

(2.) Shri A.R.Takkar, learned counsel appearing for the defendant- Municipal Committee has, at the outset, stated that although the defendant- Municipal Committee has been held to be the owner of the suit property but it shall not dispossess the plaintiff except in due course of law.

(3.) In view of the aforesaid stand taken by the learned counsel for the respondent, the present appeal is disposed of and it is directed that the plaintiff-appellant shall not be dispossessed from the suit property except in due course of law.
