JUDGEMENT

(1.) Notice of motion was issued by this court in the present petition on July 12,2004 and the following order was passed :

(2.) On the asking of the court, Mr. S.S.Behl, Additional Advocate General,Punjab accepts notice on behalf of respondent No.2 and seeks time to file reply. May do so within four weeks with an advance copy to the counsel opposite. Dasti only for respondent No.1."

(3.) During the course of arguments, Shri G.S.Bajwa,learned counsel appearing for the petitioner has contended that although the petitioner has been allotted a plot measuring 150 sq. yards but the possession thereof has not been given so far. Shri Ankur Mittal, learned counsel for the respondent-Trust, on instructions from the Trust, has stated that the actual physical possession of the allotted plot shall be handed over to the petitioner within a period of four weeks from the date a certified copy of this order is received. In view of the aforesaid stand taken by the respondent-Trust, we dispose of the present petition as having been rendered infructuous.
