(2.) OFFENCE alleged is under sections 467/468/471 IPC. Case of the prosecution is that Sat Pal forged power of attorney of Vishnu Parkash in his favour and tried to sell the property. However, the sale did not materialize. The petitioner was a witness on the power of attorney. Counsel for the petitioner submits that since no further steps have been taken, question whether the petitioner had dishonest intention in his being an attesting witness is a matter, which will require investigation or adjudication and arrest of the petitioner before investigation or adjudication is not called for. Without expressing any final opinion on merits, the petitioner is granted anticipatory bail till conclusion of investigation or three months whichever is later during which the petitioner will be free to apply for regular bail to the concerned court in accordance with law.
