(1.) Through the instant writ petition, the petitioner claims appointment on compassionate grounds as a constable under the ex- gratia scheme. The pleadings in the instant writ petition reveal, that the aforesaid claim is based on the death of the petitioner's father, who was employed as constable in the Police Department of the State government. The father of the petitioner, Dilbag Singh is stated to have died on 19.1.1987. In order to over-come the delay in seeking employment on compassionate grounds, the pleadings in the instant writ petition reveal, that a First Information Report was registered against the petitioner on 13.5.1995, and that the petitioner was acquitted after his trial by the Criminal Court, on 1.8.2001. We are of the view, that the pendency of proceedings against the petitioner before the Criminal Court on 13.5.1995, cannot be taken into consideration for condoning the delay in seeking appointment on compassionate grounds.

Since the father of the petitioner had died as far back as in 1987, we are of the view, that compassionate appointment to the petitioner cannot be granted on account of the fact, that compassionate appointment under the ex-gratia scheme is to tide over the financial hardship in which the family of an employee is placed on account of his sudden death.
(3.) In view of the above, we find no merit in this petition. The same is, accordingly, dismissed.
