JUDGEMENT

(1.) The petitioners have filed this petition under Section 482 of the Code of Criminal Procedure for quashing of criminal complaint No. 25 of 17/2/2004 under Sections 323, 341, 350, 506-B, 34 IPC and the summoning order dated 21/8/2004 along with all the subsequent proceedings arising therefrom.

(2.) After arguing for some time, counsel for the petitioners states that he confines his prayer to the extent that the petitioners may be permitted to withdraw this petition and personal appearance of petitioners No.1 and 2 before the trial court during the pendency of trial be exempted, as they are Non Resident Indians. Counsel further contends that petitioner No.3 will continue to appear before the trial court on each and every date of hearing and as and when, petitioners No.1 and 2 will be called by the trial court, they will appear before the court.

(3.) Dismissed as withdrawn. In case, petitioners No.1 and 2 file an application for exemption from personal appearance, the same shall be considered and they will be granted exemption by the trial court subject to the terms and conditions to be fixed by it.
