KASHMIRI LAL Vs. STATE OF HARYANA

Decided On April 27, 2006
KASHMIRI LAL Appellant
V/S
STATE OF HARYANA Respondents

JUDGEMENT

(1.) The matter is squarely covered by the Constitution Bench judgment of the Supreme Court in the case of Secretary, State of Karnataka and others Vs. Uma Devi and Others, JT 2006 (4) SC 420.

(2.) The services of the petitioner have already been regularised from September 9, 1998 and the relief claimed is that he is entitled to be regularised with effect from a date person employed later than him has been regularised.

(3.) We are unable to understand as to how such a relief can be given in view of the principle laid down by the Hon'ble Supreme Court in the aforementioned judgment, especially when there cannot be any seniority list of employees who have been employed on contract basis. Dismissed.
