The challenge in the present revision petition is to the order passed by the learned Executing Court on 15.05.2004 whereby the execution of the decree dated 5.3.2002 was dismissed as fully satisfied. The plaintiff-petitioner filed a suit on 13.05.1999 for declaration to the effect that the action of the defendant by not providing employment to the plaintiff on compassionate ground is illegal, null and void. The said suit was decreed on 5.3.2002 whereby it was found that the petitioner was entitled to be considered for appointment on compassionate ground in accordance with the rules and regulations of the Board. In pursuance of such decree, the Board has passed an order on 27.02.2003 to the effect that the legal heirs of the deceased should apply for compassionate employment within two years from the date of death in terms of the instructions issued by the Board on 17.02.1997 following the policy of the Punjab Government.
(2.) The husband of the petitioner has died on 28.03.1992. The suit for declaration was filed on 13.05.1999. The petitioner cannot claim any right of employment after long lapse of time. The order passed by the Board is based upon the judgment of Hon'ble Supreme Court in Umesh Kumar Nagpal vs. State of Haryana and others, 1994(3) SCT 174.
(3.) In view of the above, I do not find that the order passed by the learned Executing Court suffers from any patent illegality or material irregularity warranting interference by this Court in exercise of its revisional jurisdiction.
