JUDGEMENT

(1.) LEARNED State counsel has filed a short affidavit of Shri Mukul Joshi, Financial Commissioner Taxation in the connected C.O.C.P. No. 790 of 2005. The stand taken in the affidavit is that Hon'ble the Supreme Court in S.L.P. CC No. 10826 of 2005 has stayed the proceedings in the instant contempt petition, vide order dated 2.12.2005 (R-1). In view of above, nothing survives for determination in these proceedings. Rule discharged. However, the petitioner shall be at liberty to file a fresh petition if such a necessity arises.
