JUDGEMENT

(1.) THERE are allegations in the FIR, which will require trial. Mere denial of the said allegations cannot be a ground for quashing. Counsel for the complainant also points out that Criminal Misc. No.57701-M of 2004 filed by Anil Kumar Dhiman and Amit Kumar Dhiman was dismissed as withdrawn on 27.9.2005. The petition is dismissed. Petitioner No.1 is said to be serving at Jodhpur. The trial court will grant exemption from personal appearance to him subject to appropriate conditions being laid down, if any such application is being filed.
