RAMESH MAHAJAN Vs. SARWAN KUMAR

JUDGEMENT

(1.) The petitioner filed C.W.P.No.823 of 2003, which was disposed of on January 20, 2003 with a direction to consider his legal notice and dispose of the same by passing a speaking order within three months. Alleging non-compliance of the said order, this contempt petition has been filed.

(2.) In response to the show cause notice, affidavits have been filed by the President and Executive Officer, Municipal Council, Pathankot. Along with his affidavit, the Executive Officer has appended a copy of the speaking order dated 29.4.2003 (Annexure R-1) which was passed in compliance to the directions issued by this Court.

(3.) Learned counsel for the respondents, however, refers to the averments made in para 6 of the affidavit of the President of the Municipal Council, wherein it is stated that the pension and DA payable to the petitioner are to be released by the Office of Director, Local Bodies, Punjab as he belongs to Provincialised Cadre.
