JUDGEMENT

(1.) This petition filed under Article 226 of the Constitution prays for issuance of a writ in the nature of mandamus directing the respondents to promote the petitioner to the post of Hindi Teacher with effect from the date her juniors have been promoted vide order dated 12.4.2002 (P-4) with all consequential benefits like fixation of pay and arrears.

(2.) For the relief claimed in the instant petition, the petitioner has already sent a legal notice, dated 1.8.2006 (P-5) to the respondents.

(3.) Without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the legal notice, dated 1.8.2006 (P-5) sent by the petitioner and decide the same expeditiously preferably within a period of four months from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed by taking into consideration instructions dated 2.5.2002 (P-6) and Division Bench judgment of this Court in the case of Smt. Urmil Bhardwaj v. State of Haryana (C.W.P. No. 20579 of 2002, decided on 8.7.2004 P-7). Petition stands disposed of in the above terms.
