JUDGEMENT

(1.) The respondents are wife and minor children of the petitioner. They applied for maintenance to the Magistrate stating that the petitioner turned them out of the house in July, 2004 and neglected to maintain them. The petitioner contested the application denying the allegations. The trial court awarded a sum of Rs.1000/- per month each to the three respondents as interim maintenance. The said order has been affirmed by the revisional court.

(2.) The present petition is in the nature of second revision. In any case, the impugned orders cannot be held to be arbitrary or illegal so as to call for interference by this court under section 482 of the Code of Criminal Procedure.

(3.) The petition is dismissed. This order will not, however, affect the final order that may be passed on the basis of material, which may come on record.
