(2.) THROUGH the instant writ petition, the petitioners claim promotion to the post of Assistant Fitter with effect from the date Rohtash son of Shri Dayanand was promoted as such. In fact, the claim of the petitioners is that the petitioners' seniority over the aforesaid Rohtash came to be finalised vide order dated 18.3.2004 (Annexure P1). It is, therefore, that a right accrued to them to claim promotion from the date a person junior to them was promoted against the post of Assistant Fitter. Learned counsel for the petitioners states that in order to claim retrospective promotion with effect from the date their junior Rohtash was promoted as Assistant Fitter, the petitioners issued legal notices Annexures P3 to P6. It is, however, pointed out that no decision has been taken thereon till date.
