JUDGEMENT

(1.) This order shall dispose of Civil Writ Petitions No.14213 and 14224 of 2005 as common questions of facts and law are involved in the same. For the sake of convenience, the facts are borrowed from Civil Writ Petition No.14213 of 2005.

The grievance made by the petitioner-Company is that although the plot in question bearing No.82, Sector 44, Urban Estate, Gurgaon was allotted to it vide allotment letter dated August 2,2004 but the Estate Officer, HUDA, Gurgaon has refused to accept the payment towards second instalment of the plot in question. A further prayer has been made for issuance of a direction to the respondents to hand over the actual physical possession of the plot in question to the petitioner. Notice of motion was issued in this case on September 8,2005 but no written statement has been filed on behalf of respondents No.2 and

In view of the aforesaid facts, we dispose of the present petition with a direction to the Estate Officer,Haryana Urban Development Authority, Gurgaon to consider the claim made by the petitioner-Company. For this purpose, the petitioner shall file a detail and comprehensive representation within a period of three weeks from the date a certified copy of this order is received. Along with the aforesaid representation, the petitioner shall also append all the requisite documents. On receipt of the aforesaid representation, Estate Officer, HUDA, respondent No.3, shall pass a detailed speaking order within a period of four months from the date of filing of the aforesaid representation. Till the matter is finally decided by the Estate Officer, HUDA, Gurgaon, the interim order dated September 8,2005 shall continue to operate till further orders.
