JUDGEMENT

(1.) This judgment shall dispose of a bunch of writ petitions as a common issue is involved in all the cases.

(2.) The common issue which is involved in all the cases is as to whether when no misrepresentation had been made by an employee and some financial benefits had been granted by the department on interpretation of the rules, then whether on a later stage, on different interpretation, the recovery of the benefits already granted could be ordered ?

(3.) For the sake of convenience, the facts are borrowed from C.W.P. No. 19344 of 2003.
