JUDGEMENT

(1.) ACCORDING to the prosecution, Rama Rani was married to the petitioner and the petitioner used to take liquor and beat her. On 30.8.2005, at 8.30 a.m. the deceased rang up her sister and disclosed that she was beaten by the petitioner. Sudha Sood went to the house of the petitioner and found that the deceased had been beaten. Next day, complainant received a message that Rama Rani had died after taking poison. Question is whether an inference of abetment to commit suicide can be drawn against the petitioner from the circumstances. The petitioner is in custody for the last six months.

(2.) LEARNED counsel for the State says that case is fixed for 13.3.2006 for evidence and two witnesses have already been examined. In view of the above, no ground is made out for grant of bail at this stage. However, if there is delay in concluding the prosecution evidence beyond six months from today, for reasons not attributable to the petitioner, the trial court will grant bail to the petitioner subject to such appropriate conditions as may be laid down. Petition is disposed of.
