THIS petition filed under Article 226 of the Constitution prays for issuance of a writ in the nature of certiorari quashing order dated 26.7.2006 (P-14) transferring the petitioner from Government Girls Senior Secondary School, Jind to Government Girls Senior Secondary School Baroda, where the curriculum of Scouting does not exist. It has been asserted that the impugned order has been passed in violation of the instructions/policies dated 22.4.1997, 16.3.2001, 6.10.2004 and 9.7.2006 (P-11, P-12, P-15 and P-16 respectively). A further prayer has been made for directing respondent No. 2 to decide representation dated 5.10.2006 (P-18) and to cancel the transfer of the petitioner. The petitioner has also placed reliance on the judgment of this Court passed in C.W.P. No. 16739 of 2004, decided on 29.10.2004 (P-17), which was earlier filed by the petitioner.
