JUDGEMENT

(1.) The plaintiff has concurrently lost before the two courts below and has approached this Court through the present Regular Second Appeal.

(2.) A suit for declaration, challenging the order of punishment and rejection of his appeal and revision passed by the defendants was dismissed by the trial court. His appeal also failed before the appellate court. By way of punishment, he was awarded stoppage of two annual grade increments with cumulative effect. The order was upheld in appeal and revision before the departmental authorities.

(3.) Both the courts below have concurrently held that the punishment had been awarded to the plaintiff after holding a departmental inquiry and in accordance with the procedure established under the rules. Consequently, suit of the plaintiff was dismissed and his appeal failed before the first appellate court.
