NEW INDIA ASSURANCE CO Vs. RAJINDER KUMAR

Decided On February 03, 2006
NEW INDIA ASSURANCE CO. Appellant
V/S
RAJINDER KUMAR Respondents

JUDGEMENT

(1.) This is an application for condonation of delay of six days in filing the appeal. This application is accompanied by an affidavit. In view of the reasons given in this application, it is allowed. Delay stands condoned.

(2.) This appeal has been filed against order vide which compensation has been awarded to the respondents by the Commissioner under Workmen's Compensation Act, 1923. So far as, quantum of compensation is concerned, counsel for the appellant has failed to assail the same. Otherwise also, this Court feels that compensation awarded is perfectly justified and is rather on the lower side.

(3.) Primary grievance of the appellant is that it has wrongly been burdened with liability to pay interest. At the time of arguments, counsel for the appellant has failed to show that there was any clause in the policy with regards to non payment of interest.
