JUDGEMENT

(1.) AFTER putting in appearance, in court, on 3.9.2001, the petitioner (defendant) took several adjournments, for filing written statement. On two dates, viz. 11.1.2002 and 19.4.2002, costs were also imposed on her for not doing the needful. Still, she neither paid the costs nor filed written statement. Her defence was, ultimately, struck off by the court, vide order dated 24.4.2002, Annexure P1. She did not challenge that order before any higher court, and instead, applied for review thereof. The court dismissed the review application vide order dated 2.5.2005. This petition wherein the said two orders (dated 24.4.2002 and 2.5.2005) have been challenged, has been filed on 19.10.2006. In the facts and circumstances of the case, no ground for setting aside the impugned orders, in the exercise of extra-ordinary powers of this court, under Article 227 of the Constitution of India, is made out, after such a long and unexplained delay. Dismissed, in limine, on the short ground of delay and laches.
