JUDGEMENT

(1.) BOTH the Courts below have dismissed the suit of the plaintiff upholding the order of resumption of the booth of the plaintiff-appellant by the Estate Officer, Punjab Urban Planning and Development Authority, S.A.S. Nagar, Mohali. It is appropriate to mention that the plaintiff-appellant was a successful bidder in respect of site of Booth No. 16, Phase-I, S.A.S. Nagar, Mohali in an open auction held on 22.2.1989. He deposited 25% of the sale price. Remaining 75% was required to be paid in four annual instalments with interest @ 7% per annum, which the plaintiff-appellant failed to pay. BOTH the Courts have upheld the order of resumption. There is no ground or illegality warranting admission of the appeal. Dismissed.
