JUDGEMENT

(1.) The defendant has concurrently lost before the two Courts below in a suit for possession filed by the plaintiffs The plaintiffs claimed that they are owners of the suit land and that the defendant was a trespasser.

(2.) The defendant contested the suit and claimed that he had become the owner of the suit land by way of adverse possession. Both the Courts below have concurrently held that the defendant has failed to prove that he had matured his hostile possession in ownership by way of adverse possession. Consequently, the plea raised by the defendant was rejected.

(3.) The suit filed by the plaintiffs was decreed and the appeal filed by the defendant failed before the learned first Appellate Court.
