JUDGEMENT

(1.) This order will dispose of Criminal Misc. Nos.9356-M and 8832-M of 2006. Heard.

(2.) Offence alleged is under sections 419/420/468/471/120-B IPC. On 23.2.2006, the following order was passed:-

(3.) I have heard counsel for the parties. Without expressing any opinion on merits, no case is made out for grant of anticipatory bail to petitioner Samarjit Kaur. Criminal Misc. No.9356-M of 2006 is dismissed. As regards Criminal Misc. No.8832-M of 2006 filed by Sameer kalra, it is pointed out that the petitioner is an attesting witness and whether he had dishonest intention in identifying the co-accused is a matter, which will require investigation or adjudication before arrest of the petitioner and at this stage, arrest of the petitioner is not called for; the petitioner is willing to join investigation and face proceedings in accordance with law. In view of the above, without expressing any opinion on merits, petitioner Sameer Kalra is granted anticipatory bail till conclusion of investigation or three months whichever is later during which the petitioner will be free to apply for regular bail to the concerned court in accordance with law.
