JUDGEMENT

(1.) This application has been moved for condonation of delay of 725 days in refiling the appeal. Application is accompanied by an affidavit of the counsel. In view of the reasons given in this application, it is allowed. Delay stands condoned.

(2.) Appellant-plaintiff filed a suit claiming declaration that he was owner and in possession of the property in dispute. His suit was dismissed. He also failed in appeal.

(3.) It has been noticed by both the Courts below that the property in dispute has already been declared surplus and possession has been obtained by the State and further it was allotted to respondent Nos.3 to 6. Those orders have become final as were not challenged before the competent authorities under the Haryana Ceiling of Land Holdings Act, 1972.
