JUDGEMENT

(1.) THE petitioner, who is an accused in case FIR No. 66 dated 7.4.1994 under Sections 15/61/85 of the NDPS Act, registered at Police Station, Jagraon, Tehsil and District Ludhiana, has prayed for bail.

(2.) IT is contended by counsel for the petitioner that two other co-accused of the petitioner, namely, Darshan Singh and Daler Singh, have been acquitted by the Judge, Special Court, Ludhiana, vide judgment dated 22.5.2003. Counsel contends that the allegations against the petitioner are similar to aforementioned two accused, therefore, the petitioner deserves to be released on bail.

(3.) HOWEVER , keeping in view the fact that the co-accused of the petitioner have already been acquitted by the trial Court, therefore, I grant bail to the appellant to the satisfaction of Chief Judicial Magistrate, Ludhiana. Petition allowed.
