JUDGEMENT

(1.) PETITIONER was on bail, when he failed to appear before the trial Court on September 26, 2005. His bail bonds were cancelled. He was rearrested on November 17, 2005. Facts, mentioned above, have not been controverted by the State counsel on getting instructions of ASI Raj Singh. This Court is of the view that for remaining absent on one date, petitioner has been sufficiently punished.

(2.) WITHOUT expressing any opinion on merits of the case, this petition is allowed and during the pendency of the trial, the petitioner is directed to be released on bail to the satisfaction of the trial Court.
