By way of this judgment we shall be disposing of a bunch of writ petitions bearing Nos. 9612 of 1987, 6821 of 1988, 12328 of 1989, 3022 of 1991, 14165 of 1992, 13557 of 1993, 824, 1949, 2455,12240, 2593,2945, 3780,11027,17153, 18479, 2774, 10506, 10517, 10750 and 10348 of 1994 as the question involved is common. The petitioners have claimed a writ of mandamus for releasing the salary of summer vacations for different periods ranging from 1971 to 1986. The Hon'ble Supreme Court while dealing with a similar situation in Civil Appeal No. 3535 of 1989, decided on July 23, 1990, passed the following order:-
(2.) After passing of the aforementioned order by the Apex Court, several writ petitions came up for hearing before different benches. This Court has been consistently granting the benefits of salary of summer vacations to all the teachers who were similarly situated irrespective of the fact whether they have approached the Court belatedly or at an early stage. Not only that, general directions were also issued to the Education Department to release the salary do not have to approach the Court by way of separate writ petitions.
(3.) Consequently, we hereby allow the writ petitions and direct the respondents to pay the salary of summer vacations to the petitioners for the period which have been claimed by them in their writ petitions within a period of three months from today. No costs.
