JUDGEMENT

(1.) This shall dispose of Civil Writ Petitions No. 5737, 5744, 5745, 6623 of 1991, 7358, 8785, 7376, 7602, 13836 of 1992 and 361 of 1993.

(2.) In all these writ petitions, petitioners were duly selected as Head Constables in the Haryana Police. Subsequently, they were promoted as Head Constables on officiating/ad hoc basis on various dates as mentioned in their respective writ petitions. In the writ petitions, petitioners are challenging the orders whereby they have been sought to be reverted to the post of Constables.

(3.) In Civil Writ Petition No. 5737 of 1991, petitioner was promoted as Head Constable on 23.1.1983 and sought to be reverted to the post of Constable on 24.3.1991. In Civil Writ Petition No. 5745 of 1991, petitioner was promoted as Head Constable on 2.11.1982 and sought to be reverted on 8.2.1990. In Civil Writ Petition No. 5744 of 1991, petitioner was promoted on 28.12.1989 and reverted on 24.3.1991. In Civil Writ Petition No. 6623 of 1991, petitioner was promoted on 28.12.1991 and sought to be reverted on 24.3.1991. In Civil Writ Petition No. 8785 of 1992, petitioner was promoted on 30.4.1984 and sought to be reverted on 2.6.1992. In Civil Writ Petition No. 7358 of 1992, petitioner was promoted on 16.1.1990 and sought to be reverted on 27.5.1992. In Civil Writ Petition No. 7376 of 1992, petitioner was promoted on 10.10.1978 and sought to be reverted on 27.5.1992. In Civil Writ Petition No. 13836 of 1992, petitioner was promoted on 5.7.1988 and sought to be reverted on 2.6.1992. In Civil Writ Petition No. 361 of 1993, petitioner was promoted on 22.9.1988 and sought to be reverted on 27.5.1992. Likewise, in Civil Writ Petition No. 7602 of 1992, petitioners 1, 2, 3 and 4 were promoted on officiating/ad hoc basis on 1.12.1983, 22.10.1986, 4.10.1985 and 23.10.1986 respectively and they have been sought to be reverted as Constables by order dated 2.6.1992. In all these petitions, apart from others the main grievance of the petitioners is that they could not be reverted without having been afforded an opportunity of hearing.
