(1.) The petitioner's name was sponsored by the Employment Exchange for the post of Lecturer in Mechanical Engineering to the office of the Director of Technical Education, Haryana, respondent No. 2. The petitioner appeared for interview on 4.4.1995 before respondent No. 2 but he was not interviewed on the ground that he did not fulfil the qualification prescribed for the post. Aggrieved against the action of the respondent, the petitioner has filed the present petition praying for issuance of a direction to respondent to consider him eligible for the post of Lecturer in Mechanical Engineering and to interview him on the basis of A.M.I.E. qualification which has been duly recognised by the Government of India.
(2.) On notice of motion having been issued, respondent-State has put in appearance and filed written statement. The plea taken in the written statement is that as per Service Rules of the Department of Technical Education, the qualification prescribed for the post of Lecturer in Mechanical Engineering is Bachelor's degree in Mechanical Engineering or Technology from a recognised University/Institute with atleast 55% marks and the A.M.I.E. qualifications is not the prescribed qualification under the Service Rules. As such the petitioner in not eligible for appointment.
(3.) After having considered the submissions of learned counsel for the parties and perusing the paper book, we are of the view that there is no merit in the submission of learned State counsel.
