JUDGEMENT

(1.) This order will dispose of a bunch of 7 writ petitions No. 5753 of 1995, 15033, 16450, 16451, 17678 of 1991, 14926 of 1994 and 294 of 1995 in which common questions of law and fact arise. Since arguments were addressed in C.W.P. No. 5753 of 1995, the facts are being taken from this case.

(2.) Petitioners who are working as daily wagers in the Public Health Division at Karnal have filed this petition under Article 226 of the Constitution claiming a regular scale of pay as is being granted to their counterparts who are working as regular employees in the same Department and performing similar/identical nature of duties. This claim has been made on the principle of 'equal pay for equal work'. It is alleged that most of the petitioners except the Pump Operators are being paid a consolidated sum of Rs. 1123/- per month and the Pump Operators are being paid Rs. 1219/- per month whereas the regular employees working as Maali-cum-Chowkidar, Sewerman and Helper, etc, are getting a scale of Rs. 750-940 and the Pump Operators who possess the I.T.I. qualification are getting a scale of Rs. 1200-2040 and those who are non-I.T.I. are being given the scale of Rs. 950-1400. It is not disputed that all the petitioners have put in more than 240 days of service.

In the written statement filed on behalf of the respondents, the claim of the petitioners has been disputed and it is stated that the nature of work done by the petitioners is not the same as that of the regular employees as they are daily wagers. The fact that they have put in more than 240 days of service has not been denied.
