JUDGEMENT

(1.) These three writ petition Nos. 13139 of 1990, 14283 of 1993 and 12866 of 1991, raise a common issue as to whether non- teaching employees of the Education Department can be considered for appointment to the posts of Masters/Mistresses, if they possess requisite qualifications and experience prescribed for the said posts.

(2.) In all these writ petitions, the main grouse is that the non-teaching employees of the Education Department have no promotional avenue in their service careers in the statutory rules. It is true that there is no such avenue. But it is not possible for this Court to legislate in the matter and provide promotion avenues. However, we recommend to the State Government to consider the claims of the non-teaching employees of the Education Department for appointment to the posts of Masters/Mistresses if they possess requisite qualifications and experience prescribed for the said posts. The petitioners will make proper representations to the authorities concerned. On receiving such representations, the authorities concerned will consider how best the representations can be disposed of. The representations be disposed of expeditiously and preferably within six months from the date of the receipt of the same.

(3.) Writ petitions to stand disposed of in the above terms. No order as to costs.
