(1.) The petitioner was enrolled in the Indian Air Force on Dec. 14, 1957. He was discharged from service on Jan. 31, 1993. The petitioner alleges that he was suffering from Immature Cataract of the left eye at the time of his discharge from the service. Consequently, he made a claim for the grant of disability pension. This claim was declined vide order dated Sept. 23, 1993. The petitioner was, however, informed that in case he was not satisfied with this decision, he could make an appeal by March 20, 1994. The petitioner submitted an appeal on March 12, 1994. A copy of the appeal has been produced as Annexure P-3 with the writ petition. This appeal was forwarded to the Quarters concerned vide letter dated March 25,1994. It has not been decided so far.
(2.) The grant of disability pension is governed by the regulations. The petitioners appeal has been pending for more than a year. In the circumstances of the case, it appears to be just and reasonable to direct the respondents to decide this appeal within three months from the date of receipt of a copy of this order.
(3.) Accordingly, the respondents are directed to decide the appeal filed by the petitioner within three months. If the petitioner is found entitled to the grant of disability pension, necessary consequential relief in the nature of arrears of pension shall be released to him. In the circumstances of the case, there will no order as to costs. Order accordingly.
