TEJA SINGH Vs. MEHANGA SINGH

Decided On September 09, 1985
TEJA SINGH Appellant
V/S
Mehanga Singh Respondents

JUDGEMENT

(1.) THIS is tenant's petition against whom eviction order has been passed by both the authorities below.

(2.) THE landlord Mahanga Singh claimed himself to be the landlord of the demised premises on account of the purchase from the Central Government through the Managing Officer, Jullundur. The ejectment was sought on the ground that the tenant was in arrears of rent and that he bonafide required the premises for his own use and occupation. The learned Rent Controller found that the landlord requires the premises in dispute for his own personal use and occupation and consequently the eviction order was passed. In appeal, the learned Appellate Authority affirmed the said findings of the Rent Controller and thus maintained the eviction order. Dissatisfied with the same, the tenant has filed this petition in this Court.

(3.) ON April 26, 1985, the said writ petition was dismissed by this Court and it has been stated at the Bar on behalf of the respondent that even the Letters Patent Appeal against the said order has also been dismissed.
