JUDGEMENT

(1.) RAMESH Kumar petitioner was convicted under Sections 7/16 of the Prevention of Food Adulteration Act and was sentenced to six months rigorous imprisonment and a fine of Rs. 500/ - by the Judicial Magistrate 1st Class, Gidderbaha. On appeal, the learned Additional Sessions Judge, Faridkot, in an exhaustive and lucid judgment had adverted to every contention raised on behalf of the petitioner and repelling the same has maintained the conviction and sentence. He has now come up by way of revision.

(2.) ON 19th December, 1980, Dr. Tirath Goyal purchased 60 gms of curd from the shop of the petitioner at Malout for analysis and after completing formalities, the sample which was sent to the Public Analyst was found to be adulterated as it was deficient in milk fat 23.0% of the minimum prescribed standard.

THE learned counsel for the petitioner has raised the identical contention as was done before the appellate Court it has been so adequately and lucidly met by the Additional Sessions Judge that it would be obviously wasteful and repetitive to cover the same ground over again. Affirming the view of the learned Additional Sessions Judge and agreeing with a number of authorities cited on the points raised by the petitioner, I would reject his contentions.
