MOHINDER SINGH Vs. STATE OF PUNJAB

Decided On October 31, 1975
MOHINDER SINGH Appellant
V/S
STATE OF PUNJAB Respondents

JUDGEMENT

(1.) The only point involved in this case is that a revision petition under the Punjab Co-operative Societies Act, 1961 , had to be heard by the Deputy Secretary to the Government. When the case came up before him, he forwarded the same to the Registrar for disposal. The appeal had been decided by an Assistant Registrar and revision petition against his order was to be heard by the Deputy Secretary to the Government. In this view of the matter it was not open to him to have forwarded the revision petition to the Registrar, Co-operative Societies for disposal. We, therefore, allow this petition and direct the Deputy Secretary to the Punjab Government, who is admittedly vested with the powers of the State Government for hearing the revision petitions under the Punjab Co-operative Societies Act, 1961 , to hear and dispose of this petition in accordance with law. No costs. Petition accepted.
