This is a petition filed by Kumar Pal Bhalla against an order of the Punjab University cancelling his result of Second Year Honours School Geology which was taken by him in April, 1964 and in which he was declared successful. He was further disqualified from taking any further examination of the University for three years, 1964, 1965, and 1966.
(2.) The circumstances leading to the issue of the above-mentioned order may briefly be stated as under :-
(3.) After passing his F.Sc. (Non-medical) in the year 1961 B.Sc. (Honours) in Geology in the year 1962 and the second year Honours in Geology in the year 1963 the petitioner took the examination for the second year Honours School Geology in April, 1964. One Prithijit Singh who was a classmate of the petitioner, had to take his Special Examination in March, 1964 in B.Sc. Honours School (Subsidiary). It appears that on 6th of March, 1964, when he was taking the mathematics paper, he was found, by the supervisor, copying from a handwritten chit in his possession just before the time was up. The matter was, in due course, reported to the University. Prithijit Singh denied that the chit was in his handwriting or was found in his possession. Subsequently on receipt of an anonymous letter the University began to suspect that the handwritten chit was smuggled into the examination hall by the petitioner and Kulbir Singh were consequently summoned to appear before Mr. V.P. Verma, Assistant Registrar, and both of them denied having any hand either in writing the chit or smuggling it into the examination hall. To question No. 7A put to the petitioner on 29th of May, 1964 with regard to the handwriting on the chit, which was recovered from Prithijit Singh, the answer given was -
